Texas Law Mandates Age Verification for App Downloads Amid Ongoing Legal Battle

The U.S. Supreme Court has decided not to block a Texas law that mandates age verification for app downloads, enabling the state to enforce this measure while a legal challenge is ongoing. This ruling allows Senate Bill 2420, referred to as the App Store Accountability Act, to remain in effect as the case returns to the 5th U.S. Circuit Court of Appeals, which is set to hear arguments regarding its constitutionality in early August.

Enacted in 2025, SB 2420 obligates app store operators, including major platforms like Apple and Google, to confirm the ages of users and acquire consent from a parent or guardian before allowing anyone under 18 to download apps or make in-app purchases. Additionally, app developers must categorize their products for specific age brackets: those under 13, teens aged 13 to 15, older teens aged 16 and 17, and adults aged 18 and above.

Texas Attorney General Ken Paxton has praised the ruling as a success in safeguarding children online. However, the law has faced opposition from the Computer and Communications Industry Association and Students Engaged in Advancing Texas, who argue that it infringes upon First Amendment rights. CCIA President Matt Schruers stated that individuals should not be required to provide personal information to access the internet, likening it to needing ID to enter a bookstore.

The law's journey through the courts has been tumultuous. A federal judge in Austin previously blocked the law, citing potential First Amendment violations, but Texas appealed, and the 5th Circuit allowed enforcement while awaiting a decision on the law's merits. The Supreme Court's recent order maintains this enforcement status without addressing the constitutional issues at stake, leaving room for either party to appeal to the justices after the 5th Circuit's ruling.
